LEGISLATIVE ALERT!

The Colorado Aviation Fuel Sales Tax program remains in jeopardy.  Although airlines backed off of their efforts to attack these important aviation infrastructure revenues during the recent 2009 Colorado legislative session, all indications are that a major effort will be made in the upcoming 2010 legislative session.  If this effort is successful in reducing, restricting, or eliminating these revenues, the loss will be devastating to the entire Colorado airport system.

BILLS TO WATCH FOR IN THE 2010 COLORADO LEGISLATIVE SESSION:

Disclosure of Airport Noise Impacts
- This bill would place requirements on developers and others in disclosing a properties proximity to an airport within the State of Colorado.  A draft bill was reviewed by CAOA and CDOA during the 2009 legislative session, but it was not introduced because of concerns that existed over the language, and the potential for strong opposition from other groups within Colorado.  The bill is being re-drafted with the intent on having it introduced in the 2010 legislative session, and an opportunity for CAOA to review and provide input on it is expected during the legislative break.

Military Buffer Zone Bill - This bill was introduced during the 2009 legislative session and was defeated due to the efforts of several affected airports and communities.  It is in the process of being re-drafted for re-introduction during the 2010 legislative session.  This bill as originally written would have established significant and highly restrictive development zones in areas as much as five miles off the end of a runway at several Colorado airports which were named in the bill, due to the presence of high value military assets which are located on or near those facilities.  It is also believed that it could have constituted a "taking" of private property owner rights in many cases.  The sponsor of the bill and the Colorado Department of Military Affairs plan to meet with representatives of the affected communities during the legislative break, to discuss alternatives under which those communities may support a similar bill in the 2010 session.
